1. Customer Qualification & Legal Notice

To purchase from Midwest Goods Inc, you must:

  • Be 21 years of age or older.
  • Be a licensed retail/wholesale business or maintain any other license required under applicable state laws.

Midwest Goods Inc reserves the right to request additional documentation verifying business status.

Health & Safety Warning:

Products sold contain nicotine — a toxic and addictive substance. These products are intended only for legal age. They must not be used by:

  • Children
  • Non-smokers
  • Pregnant women or those who may become pregnant
  • People with heart disease, high blood pressure, asthma, or other serious conditions

Nicotine products:

  • May be poisonous if orally ingested
  • Must be kept out of reach of children and pets

If you suspect nicotine poisoning, call Poison Control at 1-800-222-1222.

2. Product Legality & Compliance

Midwest Goods Inc. sells exclusively to licensed retailers and distributors. Buyers are fully responsible for ensuring compliance with all applicable:

  • Federal, state, and local laws
  • Flavor bans and age restrictions
  • PACT Act reporting requirements
  • FDA PMTA (Premarket Tobacco Product Application) regulations

Midwest Goods Inc. does not offer legal or tax advice. It makes no guarantees regarding the legality of its products in any jurisdiction. By purchasing, you agree to indemnify, defend, and hold harmless Midwest Goods Inc., its officers, agents, and employees from any claims, penalties, legal actions, damages, liabilities, losses, or expenses (including attorney’s fees and costs) arising out of or related to:

(a) any resale, marketing, or use of the products in violation of applicable law, or

(b) any third-party claims resulting from your handling, storage, use, or sale of the products, except where caused solely by Midwest Goods Inc.’s negligence.

Midwest Goods Inc. reserves the right to suspend or terminate customer accounts for violations of these terms, suspected misuse, or non-compliance with applicable laws.

3. Tax Responsibility & Licensing

Tax Collection Jurisdictions:

Midwest Goods Inc. collects and remits taxes in the following states: CA, CO, CT, DE, DC, GA, HI, IL, IN, KS, KY, LA, ME, MA, MN, NE, NH, NJ, NM, NC, OH, PA, RI, UT, VT, VA, WA, WV, WI, WY, OR

  • Oregon: Taxes under ORS 323.500–323.645 have been or will be paid.
  • Virginia: Tobacco Products Tax Paid.

In all other states, taxes are not collected. The buyer is responsible for reporting and remitting applicable taxes. For detailed information about the Tax Click Here.

Excise Tax Responsibility Notice:

If taxes are omitted or under-collected due to system error or other reasons:

  • The buyer agrees to reimburse Midwest Goods Inc. in full.
  • If assessed by a taxing authority, the buyer remains liable for the total amount due, including penalties and interest.
  • Midwest Goods Inc. reserves the right to pursue recovery, including legal action or collections.

4. Reseller Certification & Export Compliance

Buyers must be licensed businesses and are responsible for maintaining valid retail/distributor licenses.

Midwest Goods Inc. reserves the right to:

  • Request reseller documentation at any time
  • Cancel or refuse orders without proper certification

Export Compliance:

Buyers are responsible for complying with international laws, including customs, export/import restrictions, and product legality in destination countries. Midwest Goods Inc. is not liable for issues arising during international shipment.

5. Shipping & Delivery

Orders are processed within 1 - 2 business days

Shipping timeframes are not guaranteed. Midwest Good Inc is not responsible for delays caused by carriers.

Midwest Goods Inc assumes no responsibility for lost shipments, delivery errors, or international fees.

Shipping Days & Hours of Operation:

  • Monday through Friday, 9:00 AM – 6:00 PM CST

Holiday Closures:

  • No shipping on Christmas, Thanksgiving, New Year, Independence Day, Memorial Day, and Labor Day

Weekend Orders:

  • Orders placed on weekends will be processed Within 1-2 Business Days after payment received

Shipping Charges:

  • Calculated at checkout based on destination, weight, and item type

Residential & PO Box Shipping Policy:

  • Midwest Goods Inc. does not ship to P.O. Boxes, APO, FPO, or DPO addresses.
  • Residential addresses will only be accepted upon approval from Midwest, based on the documentation provided. If no compatible carrier is available for the verified residential address, the buyer will be contacted to coordinate an alternative commercial business address for delivery.

Saturday Delivery:

  • May occur if supported by the carrier but cannot be specifically requested.

Express Delivery Cut-Off:

  • Orders must be placed and paid before 12:30 PM CST for same-day processing. Orders placed after this time will be processed on the next business day.
  • Express Delivery is limited to a 100-mile radius from Midwest Good Inc Location

Estimated Delivery Time (after processing):

  • Pickup: IL, IN, MI, WI, IA – 1 - 2 Business days
  • Pickup Hours
    • Monday through Friday 9 AM to 6 PM
    • Saturday 10 AM to 4 PM
  • Express Delivery: 100-mile radius from Midwest Goods Inc – Same Day/Next Day
  • Standard Shipping (2-10 Business days after order processed)
  • USPS (AK/HI/PR/Guam/MP/VI): 3–10 Business Days
  • Freight (LTL): US 48 – 3–7 Business Days
  • For international shipping options, please contact our sales team for more information.

Freight Deliveries:

  • Inspect shipments before signing the Bill of Lading (BOL).
  • If damaged, note "pending inspection – box damaged" on the BOL and take a photo.
  • Freight damage must be reported within 1 - 2 business days.

6. Returns, Warranty & Defective Products

At Midwest Goods, we’re committed to providing quality products and a smooth customer experience. If you encounter an issue with your purchase, we’re here to help with a clear and fair return process.

30-Day Warranty – Manufacturer Defects Only

You may return defective items within 30 calendar days of the delivery date, as confirmed by your tracking information. Our warranty covers manufacturing defects only.

Products showing signs of misuse, improper handling, or physical damage are not covered under warranty.

Prompt Return Required

Once your return is authorized, you have 7 calendar days to ship or deliver the item to our Returns Department.

If the item is not received within this time frame, the return request will be closed and the claim denied.

Items Not Eligible for Return

The following items are non-returnable, and all sales are final:

  • E-liquids (all sizes and flavors)
  • Pods and pod packs
  • Disposable devices
  • Coils

Note: E-liquid taste is subjective and is not a valid reason for return or exchange.

Certain accessories and products may also be deemed ineligible for return, depending on product type, condition, or use, even if not explicitly listed above.

Clearance Items

All clearance items are sold as-is, are non-returnable, and carry no warranty.

Return Instructions

  • Return shipping is the responsibility of the customer.
  • All returns must include original packaging, accessories, and documents.
  • Returns missing required components may be denied or subject to partial credit.
  • Any return that does not meet the eligibility criteria (e.g., returned after the 30-day window, unauthorized, or missing key components) may be denied and either discarded or returned to the sender at Midwest Goods Inc.’s discretion. No store credit or replacement will be issued for such items.

Return Processing

Upon receipt of a return, our Returns Department will inspect every product.

If found defective, we will issue either:

  • store credit, or
  • replacement, depending on your selected resolution.

If a replacement device is not available, Midwest Goods Inc. reserves the right to issue store credit.

Exceptions & Support

All returns are subject to case-by-case exceptions. If you’re having a problem with a product purchased from Midwest Goods Inc, please contact us — we’ll do our best to assist you.

Some brands may require warranty claims to be submitted directly through the manufacturers after-sales service department. Please check the note section on the product page for specific instructions related to those brands.

7. Incorrect, Damaged, or Missing Products

  • All claims for damaged, incorrect, or missing products must be submitted within 1- 2 business days of delivery.
  • Claims related to glassware must be submitted within 1 - 2 business days.
  • Claims submitted after these deadlines will not be accepted.

8. Loyalty Rewards, Coupon Codes, Promotions & Clearance Sales

Loyalty Rewards:

  • Coupons are non-refundable.
  • If items are missing or returned, rewards points will be reinstated and the paid amount applied as store credit.

Sales Coupon Codes:

  • Can be reused unless otherwise stated.
  • Refunds or credit apply only to the itemized amount.

Unique Coupon Codes:

  • Non-reusable unless the entire order is canceled.
  • Partial returns do not reinstate code.

Promotions and Sales:

  • Promotional offers are valid while supplies last. Midwest Goods Inc is not obligated to fulfill these offers once stock is depleted. Additionally, items purchased under such promotions are final sales and not eligible for return or exchange.

Clearance Sales:

  • All sales on clearance items are final. This includes purchases made using store credit or loyalty rewards points. Clearance items are not eligible for return, exchange, or refund.

9. Privacy Policy

We respect customer privacy and use personal data only for order fulfillment, account updates, and communication. We do not share or sell customer data.

Marketing & Communication:

  • Customers are auto subscribed to promotional emails and order SMS. We may share limited contact information with our affiliated companies for internal marketing or service-related purposes.
  • You may opt out at any time by emailing support@midwestgoods.com.

Subsidiary Companies:

  • We may share your contact with affiliated companies. You can opt out by emailing us.

10. Disclaimer of Warranties & Limitation of Liability

Midwest Goods Inc. provides no warranty beyond stated policies and disclaims all implied warranties, including merchantability and fitness for a particular purpose.

We are not liable for:

  • Service interruptions
  • Lost data
  • Equipment failure
  • Errors, delays, or omissions
  • Indirect or consequential damages

If dissatisfied, your sole remedy is to stop using our services.

Note: Some state laws do not allow exclusions or limitations. In such cases, this section may not apply fully.

11. Force Majeure

Midwest Goods Inc. shall not be held liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, government actions, natural disasters, labor disputes, supply shortages, or disruptions in telecommunications or internet services.

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the State of Illinois. Any dispute or legal claim shall be exclusively resolved in the courts located in DuPage County, Illinois.

13. Modifications to Terms & Conditions

We reserve the right to change these terms at any time. Updates will be posted on this page. Continued use of our site constitutes acceptance of any changes.
